Terms of Use, Privacy Policy and Refund Policy

1. Scope

The following agreement governs the relations between EasyMed Services SA and its Customer for the EasyMedMobile.com reminder service working via SMS and offering the management of Customer's’ treatments and medical appointments (hereinafter EasyMedMobile.com).

2. Purpose

The purpose of this agreement is to provide a mobile health management tool for personal medical information, called EasyMedMobile.com, designed to help the Customer.

EasyMedMobile.com aims to help the Customer to comply with their medical treatments or to avoid missing their medical appointments by assisting them thanks to a two-way SMS messaging feature. EasyMedMobile.com also allows the Customer to store and manage their own historical medical facts (i.e. previous medications, side effects, immunizations and potential allergies).

3. Subscription

To benefit from certain features of EasyMedMobile.com platform, the Customer must purchase a subscription via the EasyMedMobile.com website.

The Customer is urged to maintain up to date medical details, indicating their Personal and Medical Data. The customer may, however, under their sole discretion, be assisted by their doctor and / or other health professionals.

Personal Data includes the Customer’s full name, home address, e-mail, username and password to access the EasyMedMobile.com service and the mobile number on which the SMS reminder is to be sent.

The Customer’s Medical Data includes type of medical treatment, day, time, dosage and frequency, side effects from treatments, allergies and vaccination history and medical appointments.

The Customer must maintain up to date personal information and Medical Data, in particular their mobile phone number and email address.

Personal and Medical Data are recorded and stored within EasyMedMobile.com. The Customer can access this information online at EasyMedMobile.com by clicking on the "Sign In" button bringing them to their personal page.

By signing the subscription to EasyMedMobile.com, the Customer agrees without any reservation with the terms and conditions outlined in this agreement.

4. Identification

When subscribing to EasyMedMobile.com, the Customer indicates his Personal Data and mobile phone number.

The Customer is identified by EasymedMobile.com by his email and password. He can access his personal page online after the identification procedure.

If the Customer forgets the password, he can receive a new password via email by submitting a request at EasyMedMobile.com.

5. Rates

The rates for EasyMedMobile.com services are charged to the Customer according to the local rates which are indicated to the Customer on the website at the time of registration.

EasyMed Services reserves the right to modify at any time the rates of EasyMedMobile.com to take into account new developments and market conditions. Such changes will not affect the price of subscriptions already undertaken. SMS costs may be modified at any time according to local mobile networks provider policies changes.

6. Payment

Payment by the Customer for the EasyMedMobile.com subscription is done by credit card on www.easymedmobile.com.

In certain countries, it is also possible to obtain cards from participating pharmacists and other health professionals. These cards contain an access code to register for the service EasyMedMobile.com. In this case, the payment by the Customer subscribing to this service is made through the pharmacist or any other healthcare professional.

Finally, clinics or any other health institution may propose to their patients the EasyMedMobile.com service for free.

Refund Policy

Because our products are available as fully functional downloads or, in case of web based products, as fully functional online accounts, the Client is able to test and try the products before buying them. For this reason, EasyMed Serrvices SA offer no refunds as a matter of policy; however, at EasyMed Services SA 's option and discretion, exceptions can be made under special circumstances.

In case of monthly payment of the subscription, monthly payments are due until termination of the contract.

7. Application

This Agreement shall apply as soon as the Customer is notified by email of his subscription to EasyMedMobile.com. This confirmation is sent to the Customer immediately following the subscription (See point 6).

Validation of the Customer's phone number account is also subject to the receipt of a confirmation SMS sent by the Customer as detailed in the EasyMedMobile.com website.

EasyMed Services reserves the right to request proof of identity and, where appropriate, to refuse registration if the Customer’s data is inaccurate or incomplete.

Data stored by the registration system of EasyMedMobile.com is used as verification of purchase date.

8. Duration and renewal of the agreement

This agreement is in force with the Customer for the duration of the Customer's subscription to EasyMedMobile.com.

The agreement shall terminate automatically at the expiry date unless the Customer renews his subscription to EasyMedMobile.com at the conditions prevailing at the time of renewal. In such circumstances, this agreement will be renewed for the entire period of the new subscription agreed by the Customer.

The renewal of this agreement with the Customer will occur upon receipt by EasyMed Services of the paid amount for EasyMedMobile.com subscription in accordance with the rates in effect at the time of renewal.

EasyMed Services SA may notify the Customer before the subscription expiry date with an offer to renew it. In renewing his subscription to EasyMedMobile.com, the Customer may continue to benefit from the service with his personal and Medical Data already stored.

In the case of a breach of this Agreement by the Customer, EasyMed Services SA reserves the right to terminate this agreement with immediate effect and remove the Customer's current subscription and any benefit arising therefrom. In such circumstances, no partial or full refund will be paid to the Customer by EasyMedMobile.com.

9. Privacy

The personal and Medical Data supplied by the Customer is strictly confidential. This information is used by EasyMed Services SA exclusively to enable the EasyMedMobile.com service.

The confidentiality of personal and Medical Data on the Customer is handled by an identification system including a username and a password. It is the Customer’s responsibility to take all measures to prevent access and misuse of his personal and Medical Data. In particular, the Customer expressly undertakes all measures to guarantee the confidentiality and security of his user name and password. The Customer bears all risks arising from the knowledge and use of these elements by third parties. Article 10 of this agreement is reserved.

The Customer undertakes to promptly inform EasyMed Services SA of any breach of security and any misuse by third parties of his user name, password or personal and Medical Data.

EasyMed Services SA will not disclose the Customer’s personal and Medical Data to third parties without explicit prior written permission of the Customer. EasyMed Services however reserves the right to use non-Medical Data transmitted by the Customer to ensure efficient operation of the EasyMedMobile.com service.

Such data can also be used to create anonymous statistics to monitor the EasyMedMobile.com service and, where appropriate, to improve it. These statistics may be disclosed publicly.

10. Customer’s Data Access by third parties

The Customer may allow his health professionals or relatives to consult the Customer's personal and Medical Data, and to register his medical appointments.

When a doctor, dentist, pharmacist, health professional or relative wants to access to personal and Medical Data of the Customer and / or enter a medical appointment, he must first receive the Customer’s permission. No access will be granted to the doctor, dentist, pharmacist, and healthcare professional or relative without the express consent of the Customer.

11. Backup and Data Processing

The preservation and processing of personal and Medical Data are made by following the safety standards for data protection and are subject to the provisions of the Swiss Federal Act on Data Protection.

The personal and Medical Data are those that the Customer has sent to EasyMed Services SA as well as data sent to EasyMed Services SA by physicians, dentists or other health professionals with express authorization of Customer, in accordance with Article 10 § 2 above. In any case, EasyMed Services SA does not collect information about the Customer; Article 9 § 4 and 9 § 5 of this agreement are reserved.

Through out the term hereof, the Customer may at any time decide to amend or delete all his Medical Data at EasyMedMobile.com by clicking on "Sign In". After the expiration of the EasyMedMobile.com subscription, the personal Medical Data can be removed only with the written request of the Customer and upon the payment of an administrative fee.

The Customer may also change, at any time during the term of this agreement, his Personal Data via the EasyMedMobile.com by clicking on "My Account". However, after the expiration of the agreement period the Customer’s account and Personal Data can be removed only with the written request of the Customer and upon the payment of an administrative fee.

12. Disclaimer

EasyMedMobile.com service development has been made accurately. EasyMed Services makes every effort to ensure top quality and reliable services.

EasyMed Services SA accepts no liability for the accuracy and completeness of medical and Personal Data concerning the Customer, which is made available and communicated to EasyMed Services SA by the Customer.

EasyMed Services SA has no control of ownership in or to the medical and Personal Data that are stored on EasyMedMobile.com. All such data therefore is under the sole contest and responsibility of the Customer, even if the Customer does not register the data personally. It belongs exclusively to the Customer to ensure the accuracy and completeness of his Medical and Personal Data and allows the Customer to modify the data without delay in case of change.

As such, the information, content and services offered by EasyMed Services SA do not substitute in any way to the consultation or prescriptions of a general practitioner or specialist.

It is the Customer’s sole responsibility to take all necessary measures to protect himself against unauthorized manipulation of his telecommunications facilities and of the data transmitted, accessible and stored on EasyMedMobile.com.

In case of loss or theft of the mobile phone or other electronic equipment to receive and send SMS, the Customer must imperatively and immediately inform EasyMed Services SA to stop and block the EasyMedMobile.com service.

EasyMed Service SA may in no circumstances be held liable for the misuse or misrepresentation of data transmitted or downloaded to the Customer or the lack of conformity vis-à-vis his treatment.

EasyMed Service SA does not guarantee continued access or operation without failure, nor the accuracy and completeness of data transmitted or downloaded.

The reminder service and management of medical treatment is done through public telecommunications facilities (mobile telephone network and Internet), which are not specifically protected for this purpose. EasyMed Services SA accepts no liability in case of damages resulting from:

  • - delays or transmission errors;
  • - technical defects, interruptions, faults, network overloads, congestion, failures and other shortcomings of telecommunications facilities;
  • - illegal action on telecommunication facilities;
  • - access, use or modification of content data by third parties and transmission of data content to third parties.

13. Termination

EasyMed Services SA reserves the right to terminate service at any time in case of security risk, fraudulent use or any other motive.

Customer will be informed immediately of any interruption of the EasyMedMobile.com service and about duration of the interruption.

EasyMed Service SA assumes no liability for health problems and damage - direct or indirect - which may result from such interruptions.

14. Communications, information and notifications

All communications, information and / or notifications to be sent under this agreement shall be in writing and shall be considered validly made if they are given:

  • To EasyMed Services SA: at the address indicated on the website EasyMedMobile.com under the folder "Contact" and / or at the following address: info@easymedmobile.com.
  • To the Customer: at private and / or electronic address stored on Customer’s personal page of EasyMedMobile.com website under "My Account" folder.

15. Modifications

EasyMed Services SA reserves the right to modify the content of this agreement, to take account of new developments and market constraints.

Such changes will not affect current agreements but will come into force in case of renewal of this agreement during the purchase of a new subscription to EasyMedMobile.com by the Customer.

16. Nullity

If any provision of this agreement would be partially or wholly considered as invalid, the validity of other provisions shall not be affected.

17. Jurisdiction and applicable law

This agreement is subject to Swiss law, particularly the rules of the mandate laid down in Articles 394 and following of the Swiss Code of Obligations.

Any dispute in connection with the validity, interpretation, application or enforcement of this agreement will be subject to the exclusive jurisdiction of ordinary courts of Geneva, subject to appeal in federal court.
